Did Somebody Else Cause the Injury?

 

If the injured party caused their own injury, then that’s it –there’s no case. The “Did somebody else cause the Injury?” is an important question and another way to think about it is,

“Can the Applicant identify another person or organization (a business, for example) or even the failed product manufactured by a business that was the catalyst that created the situation that caused the accident or physical action that resulted in the injury to the Applicant?”


In most cases, this is easily answered.  There are some cases, however, that the cause of the accident was a faulty piece of equipment (a faulty seatbelt in an automobile, for example, that caused the injury to the Applicant, even though the Applicant caused the initial accident) and the identity of the manufacturer is not known.  The truth of the matter is that in most cases the Applicant can name names, but in those cases that they cannot, don’t worry about it…

those names will be discovered by the lawyer.

The important point, once again, is this If someon else other that the Applicant did not cause the Applicant's injury, directly or indirectly, then there is no case. If other people caused the injury...the Applicant may have a case  (if all of the other criteria are met)
